Q: Can you be forced to redo your septic system if a neighbor builds on his lot that didn't perc?

We are an elderly couple who live in a house that is over 20 years old. We've had two people check out our septic system and they said there were not any problems. Yet, the neighbor had the health department to claim sewage is leaking in our yard. The guys who came to check out our system said we would know if it were by the smell and we agree. Now the health department claims we have to dig up our septic system "to be sure" and to move a line. One of the septic guys said that the neighbor removed a lot of his topsoil when he built causing a problem in his yard. His lot was deemed not to perc before he built. Why do we have to spend money we don't have to redo our system when the guy should not have built on his land in the first place? He has cows relieving themselves all over his yard because he is on a farm. Yet he claims we are causing a problem? Seems like his septic might be a problem instead since his lot would not perc.
