Q: my car was hit in a parking lot and had to file it on my insurance, can I sue her for our deductible that I had to pay
in Jan my parked car was hit, her insurnace would never get back with us or our insurance company. Finally had to file it on ours because no one would get back with us, but we had to pay our deductible and rental car. Can I take the lady that hit me to small claims and get our money back ? She was deemed at fault as she hit a parked car with her horse trailer. We are almost five months into this and her insurance comany says they are still processing the claim because it was a new trailer that she had just bought and she did not have the bill of sale. I HAD to get my vehicle fixed as it broke one of the strut arms and would pull really bad but now I am out over a thousand dollars and she is out nothing on her end. My insurance company says that they can drag this out three years and might not ever get paid back for it .....
