Q: Have a prescriptive easement, but my neighbor spent $3,500 on a survey so they could arrest me, a pattern of harassment.
Four times exonerated by same Neighbors. This is the 5th. And they had to spend $3,500 on a survey on a cold winter night, then roped off & put up cameras and no trespassing signs on my only known access to my home where I've lived for 30 years. The previous owner did not honor previous verbal agreements with my late husband. When previous co-owner of Road found out he was dead, he sold it to the same people who have been harassing us with misdemeanors. Have video of this. When you look at the map &see the previous info from the previous owner, basically we have Park Place to their Boardwalk and they want this property and know how to play the long game. They refuse to help with co-owned Road upkeep, it is1/2mile long road. I pay the taxes. They harass &arrest me. They will continue to do so until I sell cheap so they can make yet another lakefront property and get richer. I just want my peace and quiet back. No room, more to this story, since 2010 continued harassments.Pls help?
A: You will need to hire an AL attorney to file a Declaratory Judgment suit, and possible injunction. It is not cheap nor easy. You need to gather witnesses now. Otherwise your easement will be terminated.
