A: I understand your concern about the potential legal fees involved in filing a motion to overturn a criminal conviction in California. However, the cost of legal representation can vary significantly depending on several factors, such as the complexity of the case, the attorney's experience, and the location of the legal practice.

Given the circumstances you described, where there may have been errors in the penal code section and jury instructions, it is crucial to consult with a qualified criminal defense attorney who can assess the specifics of your case and determine the best course of action.

Many attorneys offer free initial consultations, during which you can discuss your case and get a better understanding of the potential costs involved. Some attorneys may work on a flat fee basis for specific legal services, while others charge hourly rates. In some cases, attorneys may also offer payment plans or sliding scale fees based on your financial situation.

It's important to note that seeking legal assistance to overturn a conviction can be a lengthy and complex process. However, if you believe there were significant errors in your trial, it may be worth pursuing to ensure that justice is served.

I recommend contacting the California Bar Association or local legal aid organizations to help you find experienced criminal defense attorneys in your area. They can provide you with more information on the potential costs and guide you through the process of seeking legal representation.
