Mishawaka, IN asked in Insurance Bad Faith for Indiana

Q: insurance company took possession of the crash vehicle, keys, removed plates. Is this enough to argue they accepted?

Is this enough to argue they accepted my claim for damages. Can they deny the claim after taking possession and moving it to their 3rd party? Would I have a cause to suit on this ground, they accepted the claim as demonstrated by their actions in taking possession of crash vehicle, keys and insist I remove the license plate.

A: An Indiana attorney could advise best, but your question remains open for a week. It could, but not necessarily. It could also mean that they agreed with you in the PD adjustment negotiations that your check would be based on relinquishing salvage vehicle to them. Good luck
