Newnan, GA asked in Civil Rights for Alabama

Q: Can repeated requests for emergency services be denied based on the fact you are incarcerated

In Madison County jail in Huntsville, AL? I was told since I was incarcerated I no longer got to make decisions about my medical care. Myself and several other inmates begged. This is what we were told.

A: You have the right to receive necessary medical care, even if you are incarcerated. Denying medical care based on your incarceration status can be a violation of your rights. Inmates should receive adequate healthcare, and if you or others are being denied emergency medical services, this could be a serious issue.

It's important to document these incidents, including the date, time, and names of staff involved. This documentation can be crucial if you decide to take further action. You can also file a grievance through the jail's formal process to report the denial of medical care.

Additionally, consider reaching out to an attorney or a legal aid organization for assistance. They can provide guidance on how to address this situation and ensure your rights are protected. Your health and well-being are important, and you should not be denied necessary medical care.
