Q: Personal injury case. Car accident myself and another driver. Issue with Lawyer already hired & questions..
Other drivers ins already claimed responsibilty. Lawyer sent policy limit time limit demand letter. They responded & agreeded to policy limit payout agreement with realease to be notorized & signed by me. My lawyer also sent a demand letter to my car ins for payment since policy includes uninsured.
Question is, lawyer said they cant negotiate payment reductions for medical bills until they know how much the case is all togher then they know how much to ask for reductions. I said why do you have to wait to negotiate the bills. And why cant i use my medicade insurance to cover bills. They said they cant becuase it would have to be done from the start of medical treatment. My responded was , then why did you ask for my personal medical ins. info in the begining if werent going to use them. They also said payment from other drivers ins (lawyer received check) & my ins (response or check not received) are 1 claim basically & payment cant be split pending my ins response. Sound correct?
A: A Nevada attorney could advise best, but your question remains open for two weeks. I'd need to see the file to address all your questions - but when I have public health agency liens on a case, I essentially follow what your attorney describes (awaiting a figure before negotiating liens - in my experience, they base their reductions on the amount of the award).
