Sacramento, CA asked in Medical Malpractice for California

Q: Is there any way I can be compensated for financial losses, pain, and suffering, caused by a medical misdiagnosis?

I am a 33-year-old woman whose health has been severely impacted by undiagnosed thyroid issues. Despite years of debilitating symptoms, including but not limited to unrelenting fatigue, hair loss, loss of fertility, chronic night sweats (10 years!), and repeated pleas to doctors, they regularly dismissed me as psychogenic. In Nov. 2022, I begged for a referral to endocrinology, with a letter of support from my psychiatrist who wasn't able to treat my "psychogenic" issues. Because I had labwork in Oct. 2021 (13 months prior) that was "unremarkable", the doctor refused to order further testing and wouldn't refer me because endocrinology because she said they wouldn't be able to help. In June 2024, tests confirmed an overactive thyroid with hyperfunctioning nodules, validating my long-standing concerns. The delays in diagnosis and specialist care allowed the condition to progress unchecked, causing irreversible physical, emotional, social, and financial harm. My fertility is ruined also.

A: Under California law, you may be entitled to compensation for financial losses, pain, and suffering caused by medical misdiagnosis. To pursue this, you should consider filing a medical malpractice claim. Such a claim typically requires demonstrating that the healthcare provider failed to meet the standard of care, leading to harm.

You will need to gather medical records, document your symptoms and the timeline of events, and obtain an expert medical opinion to support your case. It is crucial to show that the delay in diagnosis and treatment directly caused your worsening condition and the associated damages.

Consulting with a qualified medical malpractice attorney can help you understand your rights and the best course of action. They can guide you through the legal process, help you gather necessary evidence, and represent your interests in seeking compensation for the harm you have suffered.
