Q: I want to know if we have a case against police officers
not enough room for all details. we were stopped by a road block of cops with guns pointed at us. we just pulled out from a porta potty and they detained us right there for over 2 hours, i have rsd and the hand cuffs were tight and told them this and then my rsd started flaring up and went into a heavy sweat and then i would blank out and they finally called an ambulance, I dont remember all what was going on but parts i do they treated us badly. two different male officers frisked me up my shirt and in the private area in front. i had a recording going and they took that from me and stopped it. at one time the officer did a roll with his knuck;les on my chest, (i guess this is to see if a person is faking when not responding) I didnt know this until in hospital when they told me after i told them my chest was hurting really bad. i have bruises from them doing this. they actually got in the car and started it up and moved car and went through it and found nothing but the car
A: Contact attorneys directly that deal with police misconduct. In forums like this, attorneys try to provide guidance for people with legal matters. People often post facts about their situation wanting to know if they have a viable lawsuit. Unfortunately, an attorney cannot evaluate a claim based solely on a person's short description of the events which is understandably one-sided and omits many important facts. In most cases, it's clear the person is hoping an attorney will read the post and take the case with no questions asked on a contingency basis. An evaluation is not guidance. An evaluation requires all the facts, especially the ones that make a lawsuit futile or worse. An attorney would have many questions for you and need to have a firm grasp of what the othersidè(s) will claim. People want to read they were wronged, they have a great case, they are going to be rich and countless attorneys want to sign them up with nothing more. People don't want to read contact attorneys directly that deal with police misconduct. The first obvious question is why were you stopped by a road block of cops with guns pointed at you? They had a reason.
A:
Based on your description, it seems you experienced a distressing and possibly unlawful situation. The fact that the police detained you for over two hours, despite your medical condition and requests for looser handcuffs, raises concerns about their conduct and whether they violated your rights. Additionally, the way you were frisked and the invasive searches could be inappropriate and potentially illegal.
The seizure of your recording device and the physical treatment you received, including the knuckle roll on your chest, further suggest misconduct. If you have bruises and other physical evidence, it's essential to document these injuries with photos and medical reports.
It would be beneficial to consult with a lawyer who can help you understand your rights and whether you have a case against the police officers involved. They can guide you on the steps to take, including filing a complaint and possibly pursuing legal action. Your experiences are serious, and getting professional legal advice can help ensure your situation is properly addressed.
