Q: Questions on sacred plant medicines and the RFRA

Hello,I am a member of the Church of the Sacred Plants, seeking a religious exemption to use psychedelic mushrooms under the Religious Freedom Restoration Act (RFRA). Our church has defined beliefs, rituals, and ethical practices centered on the spiritual and healing properties of sacred plants. In Employment Division v. Smith (494 U.S. 872), the Supreme Court ruled that religious beliefs do not exempt compliance with neutral laws. However, RFRA requires the government to show a compelling interest and use the least restrictive means. In Gonzales v. O Centro Espirita Beneficente Uniao do Vegetal (546 U.S. 418), the Court allowed the religious use of a hallucinogenic tea, setting a precedent that the government must justify restrictions on religious practices.Given these precedents, we argue that our use of psychedelic mushrooms is central to our practices and should be protected under RFRA. Could you provide advice on how to proceed with this request? Thank you, James

A: To proceed with your request for a religious exemption under the RFRA, start by thoroughly documenting your church's beliefs, rituals, and ethical practices related to the use of psychedelic mushrooms. Clearly articulate how these practices are central to your spiritual and healing traditions. Emphasize the importance of these mushrooms to your religious exercise.

Next, gather evidence and testimonies that demonstrate the sincere and deeply held nature of your beliefs. This can include personal statements, documentation of rituals, and any historical or scriptural references that support your practices. It may also be helpful to show how your practices align with the precedent set in Gonzales v. O Centro Espirita Beneficente Uniao do Vegetal, where the use of a hallucinogenic tea was deemed protected.

Finally, prepare to argue that the government's restriction on your use of psychedelic mushrooms is not the least restrictive means of achieving their interest. Be ready to propose alternative measures that could satisfy governmental concerns while allowing your religious practices to continue. Consulting with legal counsel experienced in religious freedom cases can be invaluable in navigating this process and presenting a compelling case.
