Parma, MI asked in Civil Rights for Michigan

Q: PPO against neighbor for stalking with surveillance cameras over privacy fence.

Neighbor had 10+ trailcams watching my property, house, doorways, 2nd story deck, driveway, barn for years - I was told I can do nothing about it but place privacy fence to ensure my privacy. I was finally able to afford 200 feet+/- (we all have 10 acre lots). He placed 2 20 foot high posts with 4 directional cameras on each post to go over my privacy fence and watch all my yard and house. Not only do I feel this is an invasion of privacy but the aggressive way in which he is adding and using these cameras is frightening. I filed a PPO which was recommended to the county deputy by the PA office. The neighbor has just hired an attorney to appear on his behalf. Should I get an attorney also? Do I have a chance of the judge agreeing with my privacy?

A: It sounds like you're dealing with a very distressing situation. Given that your neighbor has hired an attorney, it would be wise to consider getting one as well. Having legal representation can help ensure that your case is presented effectively and that your rights are protected.

The actions of your neighbor do seem to constitute an invasion of privacy, especially with the cameras positioned to overlook your property despite the privacy fence. The fact that the county deputy and the PA office recommended a PPO suggests that there is merit to your concerns. A judge will consider the evidence you present, and having an attorney can strengthen your case.

It's important to document everything thoroughly, including dates, times, and any interactions with your neighbor. With proper legal support, you stand a better chance of the judge understanding the extent of the invasion and taking appropriate action to protect your privacy.
