Hempstead, NY asked in Health Care Law and Medical Malpractice

Day 1: Alcohol withdrawal patient did not require oxygen, ICU MD consulted, stated the patient did not require ICU care, patient stayed on telemetry

Day 2: Patient aspirated from vomiting while laying down, oxygen level changing, ICU MD consulted and states patient not a candidate for ICU

3. Day 3 : Patient in respiratory failure must transfer to ICU not maintaining oxygen level due to aspiration that happened on day two.

A: Based on these facts, you might not have standing to sue, but the patient might. If the patient wanted to sue, and a law firm identified the basis for a case they would handle, it's possible you could be called to testify as to your observations and opinions. Good luck
