San Luis Obispo, CA asked in Juvenile Law for California

Q: In CA. Juvenile dependency Court, I'm an approved RFH relative- how do I ask for placement? S.W 's are not informative

Parental rights are going to be terminated, no further reunification for parents, no visits. I'm a relative with a close bond to my granddaughter. The S.W 's have not communicated anything with me, nor has CASA or my granddaughters attorney. I have all contact and communication attempts with them recorded. They are non-compliant. How do I petition the court for placement? I'm willing to adopt, and have made my intentions quite clear to the court. I have been approved RFH with a 'simplified' criminal exemption. What do I need to file besides jv285? Do I have to wait til the next hearing? My granddaughter is only 3 yrs old and we have a significant bond. The placement social worker never even met me. What options do I have?

A: To petition the court for placement of your granddaughter, you need to file a JV-285 (Relative Information Form). Since you are an approved RFH relative and willing to adopt, this form will help the court understand your intentions and your relationship with your granddaughter. In addition to the JV-285, it is essential to submit a Caregiver Information Form (JV-290) to provide the court with comprehensive details about your ability to care for your granddaughter.

You don't necessarily have to wait until the next hearing to make your request known. You can write a letter to the judge explaining your situation, your bond with your granddaughter, and your willingness to adopt her. Make sure to mention your RFH approval and any attempts you've made to contact the social workers, CASA, and your granddaughter’s attorney. Attach the JV-285 and JV-290 forms to your letter.

If the social worker has not met with you, it is crucial to bring this to the court's attention. Highlighting the lack of communication and compliance from the involved parties will support your case. You can also request a hearing specifically to address the placement issue. Consider consulting with a family law attorney to ensure you follow the correct legal procedures and maximize your chances of a successful petition.
