Q: Driver of vehicle who hit my vehicle says it wasn't them and their damage is pre existing.

Hello! I own my own business and use my personal vehicle for service calls and work transportation, fully reliant on my vehicle. On July 11th a truck (white Silverado) merged into my(grey Prius) vehicle at about 55mph. He nearly pitted himself and caused a massive pile up but after I hit the brakes he was able to correct his vehicle and continue down the road. I followed him past 6 exits and he never put on flashers, blinker, or slowed to exit. I pulled off the road as my front right tire was making noise after being hit.

I had taken pictures of his vehicle as well as video of us in the area, the damage to his truck, his license plate, and his face.

Pulled into gas station to wait on state police to create report. gave statement and gave them pics of him and my car.

Started insurance claim soon after(progressive liability and uninsured only). Turns out he has valid license and insurance through state farm.

He told his insurance it wasn't him.

A: Sometimes it's better to have an attorney represent you than you representing yourself. I believe this is 1 such situation as liability is currently in dispute by the insurance company and you have evidence to provide the insurance company on this issue---as such I would recommend that you hire an attorney to do this. If you do not want to hire an attorney, then you need to present your evidence to State Farm----but make sure you retain the original(s). Good luck.

A: You may want to reach out to Arkansas attorneys to try to arrange a free initial consult. This sounds like it's going to be a tough case. The orientation of the vehicles and damages you describe could support a number of different scenarios - and you're already looking at the other vehicle's account of things being in conflict with yours. Other attorneys could see things differently. If you choose to handle things yourself, good luck. Document as much of the damage as you can before repairs are made.
