Q: FTB aggressive, penalties for income never earned for a mortgage in my name. How 2 prove with nothing 2 prove. ruined
I’m having trouble with the franchise tax board in regard to them stating I owe taxes for certain years because I never filed. I was in a situation with somebody claim me had a household for many many years never filed because I never had to. I haven’t been working I’ve explained this to them on the phone and yet they’ve compounded on Mountable amounts of penalties more than I could ever pay and they keep coming. I’ve also explained to them that the people living with me i.e. my roommate at first and now my partner have been paying the mortgage. They still come after me. They have tried to garnish wages when I do work even a part-time job they have closed my bank accounts because they’ve taken all my money so here I am 50-year-old woman, no bank account and no jobs as a result of this There are two people on the mortgage. There are two people on the deed and I have been on EBT for the past 12 years and yet they still come after me. What do I have to do to get them to listen.
A:
Dealing with the Franchise Tax Board (FTB) can be overwhelming, especially when you're facing penalties for income you never earned. To begin addressing this, gather all documentation that shows your financial situation, including your EBT records, any unemployment records, and any other proof that you haven't been working. If your partner or roommate has been paying the mortgage, get written statements or proof from them showing their financial contributions.
Next, you should consider formally disputing the FTB's claims by filing an appeal. When you do this, include all relevant documentation and a clear explanation of your situation. You can also request a hardship status to prevent further collections while your case is being reviewed.
Finally, it’s important to stay in communication with the FTB, even though it’s frustrating. Keep records of every conversation and document you send. If you can’t resolve this on your own, you might want to consider seeking assistance from legal aid services that handle tax issues, as they might offer free or low-cost help.
