Asked in Personal Injury

Q: Can a U.S. lawyer litigate a personal injury-assault case in Canada, for a U.S.A. born citizen?

Child assault in community center. Perpetrator was another child. Children are 10-11years old.

There we're witnesses. Community center did not call security or police. Child was treated with ice to the wound. Community center was warned of perpetrators behavior, as he attacked the same child at the same community center in the passed.

A: An attorney who practices in Canada would know this. But as a GENERAL rule, if Canada follows similar protocols observed in U.S. courts, an attorney licensed there would probably be needed. U.S. courts do allow attorneys from states outside of a given court's jurisdiction to represent clients, but it generally involves making a motion to the court and having arrangements with local counsel licensed in that state. If you reached out to attorneys who practice in the province for this matter, they would be able to advise definitively. I'm sorry that the child was attacked. I hope they are okay. Good luck
