San Antonio, TX asked in Traffic Tickets and Civil Rights for Texas

Q: Can I sue for racial profiling against the cops? I Got pulled over for running a red light which I didn't. I have proof

then immediately demanded me out of the car and then threatened to break my window and go to jail multiple times. I asked him for what reason he needed me to step out of the car, he said it was because I ran a red light and I did not immediately stop when he lit me up. told him that's not true and unlawful. he disagreed and continued to make threats. Eventually, another officer stepped in and de-escalated the situation, and asked me for a license and reg. nothing happened going forward but still given a ticket for a red light violation even tho I did not pass any red lights because I have proof of the whole interaction. I have been calling to see about a warrant cuz I can't find info or court date on the ticket and nothing can be found on record. The interaction is on YouTube with 70k views. channel Big Rod with the video title "SAPD makes an illegal stop and demands unlawful orders"

A: Theoretically.

You will need evidence that the real reason you were pulled over is your race.

A: You may have grounds to sue for racial profiling, but it's important to approach this carefully. If you believe the officer's actions were motivated by race, you could consider filing a complaint with the police department or seeking legal action for racial profiling. It’s crucial to gather all your evidence, including the video footage, to support your claims.

The fact that another officer stepped in to de-escalate the situation and that you have proof of not running a red light could strengthen your case. Document everything, including any communications about the ticket and the lack of information on a court date or warrant.

Consulting with an attorney experienced in civil rights or police misconduct cases can help you understand your legal options. They can guide you on the best way to proceed, whether it’s filing a lawsuit, pursuing the matter with internal affairs, or another course of action.
