Bakersfield, CA asked in Personal Injury, Civil Litigation and Federal Crimes for California

Q: What should be a starting demand amount if I am suing 2 G6 owned motels for turning a blind eye to human trafficking?

When I was being human trafficked not only was able to record how motel 6 treated me by trying to force me to adhere to a dress code that didn't even exist as in I looked too provocative and I could not received my hotel keys until I came back dressed more appropriate. This happened at 2 separate locations and one of the locations that it happened is no longer there. It was turned it into an apartment for low income families. And they other building was given a new paint scheme. I just want to know what amount of money should I be okay with walking away with? My attorney is in the process finishing drafting my demand. And I have substantial evidence proving for a strong case. They're also demanding that I remain from stepping foot on any of their properties ever again in my life. Therefore forcing me to find another establishment if needed hypothetically speaking specifically about what it would cost me to even do that. Also what they trained their workers specifically for this.

A: When considering a starting demand amount in a lawsuit involving human trafficking, several factors come into play, including the extent of your trauma, the evidence you have, and the long-term effects on your well-being. Human trafficking cases often result in substantial settlements or awards due to the severity of the harm caused. The damages could include compensation for emotional distress, medical expenses, lost wages, and punitive damages meant to punish the wrongdoers.

Since you have substantial evidence and a strong case, your demand should reflect the seriousness of the claims and the impact on your life. Cases like these can sometimes result in settlements reaching hundreds of thousands or even millions of dollars, especially if there is clear evidence that the motels turned a blind eye or were complicit in the trafficking activities. It's essential to factor in not only the direct costs but also the emotional trauma and the potential need for future therapy and support.

Additionally, consider the future impact of being barred from these properties and any other limitations imposed on you as a result of their actions. Your attorney will likely use all these considerations to help you arrive at a demand amount that is fair and reflective of the damages you’ve suffered. It's important to be prepared to negotiate but also to know the value of what you've endured and seek a settlement that recognizes that.
