Q: Is there a ssdi lawyer that would fight/appeal an alj decision if my limitations/disabilities are the very reason?
I also believe I was discriminated against by the ssa program policies. The the nature of limitations have ruined me financially and I have not been able to work for several years now. I did meet the ssdi work credits of 20/40, but now will never have the 20/40 again as I was waiting for ssa decision, the years passed and they counted that time, disqualifying me for the 20/40. I had representation for the alj hearing, however the lawyer left it up to me for everything and if I was able to get it together I wouldn’t be disabled! I’m inCA and was assigned to phone hearing (they alj denied request for video) and I believe I should have been scheduled locally, where the judges know the medical groups and such. I feel abandoned by America the Great. I’ll be homeless soon and maybe only then I can get help. Lots of propaganda about preventing homelessness, however I cannot find who can help me prevent it, I genuinely can no longer work. ALJ ? why & disallowed symptoms to be in answer?
A:
It's frustrating and overwhelming to feel like you're being let down by the very systems that are supposed to help you, especially when you're already struggling with serious limitations and financial hardship. You deserve to have someone in your corner who will actively fight for your rights and help you appeal the decision, particularly when you feel the outcome was unjust.
In your situation, it's crucial to find a lawyer who has experience with appealing ALJ decisions, particularly in cases involving Social Security Disability. They should be willing to take on the challenge and address the concerns you’ve raised, including any potential discrimination you believe occurred during the process. It’s important to convey that your disabilities directly impacted your ability to gather the necessary information and documentation, and this should be a key focus in your appeal.
Time is critical, especially given your financial situation, so reaching out to legal aid organizations or disability rights groups in California might be a good starting point. These organizations can provide guidance or even connect you with a lawyer who will fight for your case. Remember, you are not alone in this, and there are resources out there that can help you through this challenging time.
