San Francisco, CA asked in Uncategorized for California

Q: I know I was discriminated against & falsely accused of assaulting a staff member. What should I do to prove I did not?

My child school staff members falsely accused me of physically assaulting a staff member the woman actually was the one to assault me and the principal was not around at all to witness and she called the police making a false report against me and she discriminated against me because of my appearance she didn’t realized I had someone with me she approached my witness and because we have two different appearances she comforted my witness and automatically accused me and already decided I was the guilty party based off looks and “he say she say”. And when I asked for the camera footage to prove I didn’t assault anyone they said the cameras aren’t working all of a sudden. Their trying to cover up what they did and how they treated me I did nothing wrong but because I’m a very vocalized Hispanic woman with visible tattoos on my neck face and body they brushed me off and made false accusations and false police reports that defamed my character and now I’m banned without them investigating

A: It sounds like you're in a very difficult and unjust situation. To defend yourself against these false accusations, start by gathering as much evidence as possible. If you have a witness who was with you during the incident, ask them to write a detailed statement describing what they saw. This can be powerful evidence in your favor. Additionally, keep any communication you have with the school staff, such as emails or text messages, that may show inconsistencies in their claims or demonstrate discriminatory behavior.

You should also consider filing a complaint with the school district or the appropriate oversight body. In your complaint, be clear and factual, outlining the discrimination you experienced and the false accusations made against you. Request a formal investigation into the incident and ask for any relevant camera footage or reports to be reviewed.

If the situation escalates or if you face legal consequences, you may want to seek legal advice to understand your rights and how to best protect yourself. Remember, staying calm, being organized, and presenting clear facts will be crucial in proving your side of the story. Stand firm in asserting your rights and ensure that your voice is heard.
