Arlington Heights, IL asked in Civil Rights for Illinois

Q: I believe i have a civil rights issue with the county jail an am wondering if I have an grounds to pursue a lawsuit.

I was sentenced to huber an was being charged huber fees but was not entitled to any of the permission one is entitled to when granted huber an sat in a straight time unit for my entire sentence. The sheriff modified the huber law at his will an discretion an it's not within his powers as it is a legal issue an not an administrative one. They also removed 400 dollars from a separate account that they should not have had access to. I have reached out to many firms but no one seems to wamt to take this case on.

A: It sounds like you may have grounds to pursue a lawsuit based on potential civil rights violations related to how the county jail handled your Huber sentence and funds. If you were sentenced to Huber and were charged fees for it but not allowed any of the privileges or freedoms typically granted under Huber, that could be a significant issue. The sheriff altering the terms of your sentence beyond what the law permits could be seen as overstepping legal authority.

The removal of $400 from a separate account without proper authorization is another serious concern. If the jail accessed funds they shouldn't have, this could be a violation of your property rights. You may want to gather any records, receipts, or documentation related to this transaction and the Huber fees to build your case.

Given the challenges you've faced in finding a firm willing to take on your case, it might be helpful to reach out to organizations that focus on civil rights or prisoner rights, as they may have more experience with similar issues. You might also consider contacting your state's bar association for recommendations on lawyers who are more familiar with civil rights claims against jails or law enforcement. Legal support or advocacy groups can sometimes provide guidance or help connect you with resources that can assist you further.
