Pendleton, OR asked in Criminal Law for Oregon

Q: Oregon; Is it possible to get Theft I expunged on my own without a lawyer? How hard would it be?

It is from March 2018, only that one felony. I’m coming up on 7 years, I have no other charges, I finished my probation March 2020 and everything is paid off. I know I am able to do the process myself but what is the risk of doing it without a lawyer? Any other information you can give me on the subject would be helpful. Umatilla county.

A: Yes, it is possible to attempt to get a Theft I charge expunged without a lawyer, but the difficulty can vary significantly based your exact circumstances.

Typically, you might need to meet certain criteria like having completed all terms of your sentence (including probation or parole), having no new criminal charges since the conviction, and sometimes waiting a specified period after your sentence. Some states might also consider factors like your age at the time of the offense, the nature of the crime, and your behavior since.

You'll need to file a petition for expungement. This involves understanding and filling out legal forms correctly, which might require some legal knowledge or at least a good understanding of the process.

Court Appearances: You might need to appear in court. While you can represent yourself (pro se), understanding court procedures, how to present your case, and respond to questions can be challenging without legal training.

Documentation: Gathering all necessary documentation, like proof of completion of sentence, no new criminal activity, and sometimes character references or proof of rehabilitation, can be daunting.

Public Records and Opposition: Prosecutors or law enforcement might oppose your petition. You'd need to argue why the expungement should be granted, which might involve understanding legal arguments or precedents.

If your case has complicating factors (like multiple charges, or if there's a history of similar offenses), navigating this without legal advice could be more complex.

If you're considering going this route, start by thoroughly researching Oregon expungement laws. Look for any state-specific guides, forms, or even online forums where others might share experiences. The county courthouse website (Multnomah, Washington, etc) may have guides as well for you. Legal aid clinics or pro se clinics at courthouses can also offer guidance without the full cost of hiring a lawyer. However, if your case has any complexities or if you find the process overwhelming, consulting with or hiring a lawyer might be advisable to ensure all bases are covered and increase your chances of success.
