Q: Cabinet refinishing company want payment for extra work caused by floor refinishing company hired by me.
I hired Cabinet refinishing company and Floor refinishing company. Cabinet refinishing company finished painting the cabinet boxes. The next day floor refinishing company came and refinished the floor. But in the process they dented and scratched cabinet box that got finished. So the Cabinet refinishing company had to do extra work to fix damaged spots. I called the floor company sales rep and was told, damages caused them would be taken care. So the cabinet refinishing company proceed with the repair. Now the floor company is denying any damages and won't call back the Cabinet company. Cabinet company wants payment from me for the extra work. Because the floor company is not calling back. I paid in full for the cabinet refinishing. But I stopped payment on half of the floor refinishing invoice. I told floor company to contact the Cabinet company and come up with resolution for both party. Until then, I'm not paying them. Am I doing it right? Am I responsible for any of the fees?
A:
It seems like you are handling the situation in a reasonable way by withholding payment to the floor company until the issue is resolved. Since you hired both companies separately, each is responsible for their own work and damages. You should not have to pay for the extra repairs caused by the floor company, as they agreed to take care of any damage they caused.
Your responsibility is to pay for the original services agreed upon with both companies, but not for the extra work resulting from damages that aren't your fault. It’s important that the two companies communicate and resolve the issue directly, rather than you paying additional fees for the repair work caused by another party.
Keeping the floor company's payment on hold until they address the problem and work with the cabinet company is a fair approach. Make sure you document everything in writing, including communications with both companies, to protect yourself in case further disputes arise.
