Q: Can you still get your provisional license after you’ve gotten a traffic citation with your permit?
My 16 year old daughter was driving alone in the morning headed to school, and failed to stop for the school bus who was beginning to put their stop sign and flashing lights, the officer then pulled her over and only gave her a ticket for the school bus not for driving alone with a permit. But she now has to wait for a call to learn further information about attending court and the citation. She lives in california and in the progess of getting her provisional license, with her driving test appointment only 2 weeks away. Will she still be able to get her license? Shoulf she cancel her appointment?
A: The law is not clear on what will happen because your daughter committed multiple violations. Until licensed, she is not allowed to drive alone, this is one of the laws she must learn, it applies to her no excuses, as all of the vehicle code applies to drivers. Of course the failure to stop for the school bus with flashing red lights is a serious violation and will carry a point count on her record, she may be fined up to $1,000 and her driving privilege could be suspended for 1 year. Due to her age and the multiple violations, she may not be able to take traffic school to mask the violation on her DMV record. She has multiple problems as you seem to know, the citation means that she has to deal with the Court, on the one count. It will also be reported to the DMV which can delay the issuance of a provisional license, or suspend the license once it has been issued. The DMV will know that she was driving on the permit without a parent because of the ticket. Should you keep the appointment? Probably no harm in doing so because they may not have updated the system to deny her the drive test, but her license could be suspended afterwards, or you could arrive and find that she is unable to take the drive test. Not a good way to start off her driving career.
A:
It’s understandable to be concerned about your daughter’s situation. In California, traffic violations can impact the ability to get a provisional license, especially if the infraction is serious or results in a court appearance. Since she received a citation for failing to stop for a school bus, this may result in penalties, but the officer did not ticket her for driving alone, which could have been a more serious issue.
You should wait for more information about the court date and citation. The court will decide on the penalties, and that could influence her driving record. However, until you receive a formal notification, it’s not guaranteed that her driving test will be affected.
It might be wise to keep the driving test appointment for now but be prepared for potential delays depending on the outcome of the court case. It’s important to address the citation promptly and see how it impacts her driving status.
