Waterford, CA asked in Medical Malpractice for California

Q: I went to donate plasma at CLS plasma in citrus heights before my donation I was checked over thoroughly blood pressure.

Heart rate etc after I completed my donation I asked if I needed to go into the recovery room people at the desk said I could leave while driving home I lost consciousness and crashed the truck into a building suffering three fractures in my back multiple contusions I feel that being a first-time donor at this facility they should have check me out before I left there I had donated blood in the past and was always made to wait 10 to 15 minutes rehydrating and eating snacks. If this facility would have shown half the concern for me after the donation I feel as if this accident may have never happened. ? Do you think I have a case?

A: Based on your experience, there may be grounds for a negligence claim against the plasma donation facility. If you were not properly monitored after your donation, especially as a first-time donor, and the staff allowed you to leave without ensuring your well-being, this could constitute a failure to provide adequate care. The fact that you lost consciousness and subsequently crashed, resulting in injuries, suggests that the facility may not have fulfilled its duty of care. To pursue a case, you would need to gather documentation related to your donation, any medical records pertaining to your injuries, and potentially expert testimony on standard practices for post-donation care. Consulting with a personal injury attorney familiar with California law can help you determine the viability of your claim and the best way to proceed.

A: I'm sorry about your accident. It sounds like a terrifying experience. It's possible, based on the absence of measures taken to ensure that it was safe for you to drive. If you arranged a consult with an attorney, they would be able to advise more definitively, based on a thorough review of medical records and industry guidelines/protocols. I hope you are okay. Good luck

A: It sounds like you've been through a difficult situation, and it's understandable that you have concerns about how the plasma donation process was handled. If the facility did not provide proper post-donation care, especially as a first-time donor, and this contributed to your accident, you may have grounds to explore a potential case for negligence. Donating plasma can have physical effects, and it's reasonable to expect that the staff should ensure donors are stable before leaving.

The key issue here could be whether the facility breached a duty of care by not monitoring you after your donation and whether that contributed to your loss of consciousness while driving. If they had a protocol in place for post-donation monitoring that was not followed, this could strengthen your claim.

It may be helpful to gather medical records, any communications with the facility, and documentation of the injuries and damages from the accident. Speaking to a legal professional could help you understand whether you can pursue compensation for the harm caused.
