Q: Can I regain custody?

I'm in NYS. cps removed my children because I continued to talk to my abuser during the time I was doing my orders. They went to my mother's house around January 2016. I have a stable living and all my bills are paid. I also have been with someone else for over 3 years and haven't talked to the abuser in years. the custody is open-ended and is left to "mother's discretion" My daughter has lived with me for over a year and I homeschool her, my son on the other hand still lives there. he is not thriving; he lacks social skills, and structure and is isolated in his room outside of school. I'm wondering if I would have a good case to get custody back if my mother chooses to fight in court instead of changing the custody order when I speak to her.
