Q: Do I have a case ?
Hello,
On February 14, 2020 A dentist performed a root canal on my lower right #30 tooth. During my root canal I kept feeling pain in my ear as she continued to perform the root canal. I told her and she just numbed me more. After my procedure was finished I continued to have pain in my tooth, ear and pain just below my ear by the jaw. The dentist told me she didn’t know if she could save my tooth.
I continued to have this pain and seeked another dentist. The new dentist referred me to a Endodontists. It was here where I discovered a broken instrument was left in my root canal. The Endodontists did a procedure to stop the tooth from hurting but was not able to remove the broken instrument due to it being so far down. The only way to remove it would be to extract the tooth. I did not want that as we need our back teeth to chew.
A:
This is a potential case. While tools breaking can occur with or without malpractice, not advising the patient would be malpractice.
The additional harm from not finding this sooner would be part of the case.
Consult with experienced malpractice attorneys in the state where this occurred. Find an attorney to domesticate and collect the judgment using this search tool https://www.justia.com/lawyers
