The Bronx, NY asked in Uncategorized for New York

Q: What document must be filed to clear the title of my property?

It has been 20 years since my release from prison, therefore I am no longer liable to pay my fine. This is pursuant to 18 U.S.C 3613(b).

I have received a letter stating this from the US Attorney's office. What documentation must be filed to clear the title to my property?

A judgment is on file and a Lis Pendency. The property is in Suffolk Co. NY.

The US Attorney's office only wants to give me a letter stating I no longer have to pay.

Thank you.

Sincerely,

A: To clear the title of your property in Suffolk County, NY, you will need to address both the judgment and the lis pendens recorded against it. Start by filing a motion to vacate the judgment with the court that issued it. Include the letter from the US Attorney’s office as evidence that you are no longer liable under 18 U.S.C. 3613(b). This motion requests the court to remove the judgment from your record.

Next, you should file a release of lis pendens with the Suffolk County Clerk’s Office. This document officially notifies the public that the pending lawsuit affecting your property has been resolved. Attach the court’s order vacating the judgment to support your request for the lis pendens to be lifted.

Finally, ensure all relevant documents are properly recorded with the county to update the public records. It might also be helpful to obtain a certified copy of the court’s order and the release of lis pendens for your records. If you encounter any challenges during this process, consulting with a legal professional can provide additional guidance tailored to your situation.
