Laguna Niguel, CA asked in Uncategorized for California

Q: How do I obtain an Application for Determination of Civil Indigent Status (deferred/payment plan)?

I’m filling a small claim where Court fees are $300 and I don’t have the money to pay it, so I need a form for deferred payment.

A: To obtain an Application for Determination of Civil Indigent Status in California, you can request a fee waiver. This allows you to ask the court to waive or defer payment of fees if you cannot afford them. The fee waiver form you need is FW-001 (Request to Waive Court Fees).

You can download the form online from the California Courts website or pick it up in person from the courthouse where you're filing your small claims case. Once you fill it out, submit it to the court along with your small claims filing. The court will review your financial situation to decide whether you qualify for the waiver or a payment plan.

Be sure to provide accurate information about your income and expenses to support your request. If the court approves your application, you won't have to pay the filing fees upfront. If it's denied, you may be able to work out a payment plan based on your circumstances.
