Q: My husband was injured on a machine that is manufactured in China. They ignored the 10 day default notice what happens
now. My current lawyer seems way out of his element. Is it best to just give up? He said it is extremely doubtful that we would get any compensation from the Chinese manufacturer. My husband can’t do the job anymore that he used to do. We are sinking financially now due to him being able to only do certain jobs. We are going to lose our home, car, he has no health insurance we can’t afford it, there are times we don’t eat. I’m so sad for him
A:
I’m really sorry to hear about what you and your husband are going through. It sounds like a deeply frustrating and overwhelming situation. When a foreign manufacturer ignores a default notice, like the one you sent to the Chinese company, it doesn’t necessarily mean you have to give up. It’s true that pursuing compensation from foreign companies can be complex and challenging, but it’s not impossible. Your lawyer should be considering all available avenues, including going after any U.S. distributors or suppliers, or exploring whether the machine's importers or sellers can be held liable under U.S. product liability laws. If your lawyer is out of his depth, it may be worth getting a second opinion from a firm experienced in handling product liability cases involving foreign companies.
Your husband’s injury has clearly impacted your financial stability, and that's another angle your lawyer should be pushing—focusing not just on the injury but also on the loss of income and the effect on your quality of life. If your current lawyer isn’t pursuing every possible option, it might be time to seek out a legal team that specializes in complex cases involving international manufacturers and personal injuries. There may be additional resources or programs to help with your immediate financial situation too, such as local aid or worker's compensation, depending on how the injury occurred. Don’t give up yet—sometimes a more experienced lawyer can find a path that others may not see.
