Q: Hi there--My ex husband has asked for my spouse to adopt our kids because he no longer wants to pay child support.

He lives out of state and the custody case is being moved to Ohio. I have asked that he pay child support through the end of the year (he stopped paying May 2024) and he is now threatening to sue me for money he "thinks" i owe him and 50% of my retirement (we've been divorced 2.5 years) because I asked him to provide child support until December. I was told by my attorney that in some cases, if the other parent is being difficult, the judge can still go through with the adoption and make them continue to pay child support. Is this true? I didnt want this but he has asked for it, doesn't contact them (has twice in a year to tell them he's unable to exercise his vistation because I told him I wouldn't be the one to let them down anymore) for maybe 5 minutes a phone call and is coming up on a year of not seeing them at all (forfeiting his custody times). Now he has stopped paying and Im stuck on what I should do. FYI I don't think he has any case against me and that its empty threats.
