Q: Can someone still file bad check charges if payments were made towards the amount of the check that bounced
I paid by personal check to a roofer in June and he cashed it a month later. By then our account diminished bcz we bought a house and had to gut it and the check bounced. He called and told me and I checked the account to make sure because I didn’t receive any notice about it from my bank. It did get returned. I told him I was sorry and would figure it out and get him his money as quickly as possible. I asked if he would be willing to take a few payments over time bcz we didn’t have the money and he said no. He sent a certified letter in September requesting the money saying to pay in 10 days or he was taking me to court. I sent him $2300 of the $4500 owed. Then last week he called yelling about the rest and I sent him another $800. I still owe $1400 but cannot pay it all at once. As of now I don’t think he’s filed anything in court. Can he still press charges at this point?
