Q: i was in an at fault accident as i pull off to the side i was hit by a car on my passenger my insurance lapsed help ?

i received a mail from my old insurance requesting an affidat. i also have two witnesses that left the scene do i have a case here i feel the opposing party is coming after me and i wanna make sure all facts are on the table. i didn't create a police report nor i can retrieve footage from traffic cameras just want to know if i have a case here
