Winston-Salem, NC asked in Construction Law for North Carolina

Q: A contractor caused damages to my appliances while repairing my home. Do I still have to pay him?

My house is being repaired due to flooding of the pipes. A contractor caused the fuses in my home to shut off by using to many dehumidifiers causing my deep freezer and refrigerator to defrost. All the food went bad ruining both the deep freezer and refrigerator spoiling all the food and even more water damage. The Insurance company advised me that damages caused by the contractor are not covered. The contractor is denying any fault. The insurance company did cover clean up because the smell became so bad.I still have the check from the insurance company to pay the contractor. Can I take the damages out of the check? The insurance company bought it to my attention that he also lied about times that he was working adding to pay more for rental equipment and causing my family to live in a hotel for 3 months now. He even requested more money from the insurance company for things he didn’t do. I have since switched to a new contractor recommended by the insurance company.
