Asked in Family Law and Child Custody for Alabama

Q: Can I force my ex-husband to receive our children by a certain date?

My child's father refused to give medication to my child so I filed an emergency motion to suspend visitation. He then decided that he would give him the medication so the motion was dismissed. This situation took three months to resolve. Now our custody time is out of order and he is refusing to take the kids until he is available. This forces me to lose scheduled holidays with the children. Our custody agreement simply states "equal shared time". We create the schedule and dates at the beginning of the year. Because he refused care for our child, waiting over a month to even respond with his refusal to give him meds and then almost another month to retract that refusal so he didn't have to go to court, he is owed 6 weeks of our equal time. He is now saying that he won't be available, because of plans he had previously made, to take the kids until even longer in the year. This forces me to lose the kids on Christmas, which we had already agreed that I would have them
