Q: What protections are there for tenants in apartment buildings that do not want to be exposed to secondhand smoke?
I recently moved to a new apartment. Prior to moving the landlord did inform that the lady next door smokes inside. At the time I did not think this was an issue but after living here for a little while the smoke has become an issue and I am concerned about my health. My lease says that I am not allowed to smoke in the apartment. I am wondering what type of legal protections there are to guard against second hand smoke from neighbors. Can one tenant be allowed to smoke inside the apartment while the others are expected to smoke outside of the apartment?
