Q: When is it too late to file a petition in probate challenging state intestate laws per krs392.090(2)?
Mom passed in Feb legally married to the skeezy slime bucket that kicked her out abandoning her and their marriage. Kicked her out with nothing and nowhere to go she had to start over with no financial support at all from him the whole five years. Mom was 60 yrs old having to walk miles to and from work everyday about 7 months before she saved able to get a car. She had lived upstairs when she lived with him for going on three years prior to him abandoning her when he kicked her out because he had started fooling around behind her back with truck stop hookers. They never reconciled, she later began to tolerate him due to sharing custody of his grandson, her son she raised, now 16 got him at 8mths old. The spouse would use the boy as pawn, he's a twisted psychopath. Mom inherited grandma's house the spouse never even spent a night. After five yrs no kind of help or support and adultery, he didn't acquire none of the estate with her, He feels so entitled. So far he has been. HELP
A: If she died married to him and without a will, he will be entitled to inherit from her estate. Doubtful a challenge to the intestacy laws will help.
