Q: Looking for guidance on this section of a city rental registration ordinance in the state of Pennsylvania.
373- 9 Violations, Penalties, and Other penalties.
"Any Person who shall violate a provision of this Chapter or shall fail to comply with any of the requirements hereof shall, upon conviction before a Magisterial District Judge having competent jurisdiction in the City of Scranton, be liable to pay the following penalties for each and every offense" It then goes on to list 1st-3rd third violation with fine amounts for each. The way I am reading this is that they have to actually find me guilty before they can start giving violations. Except when they gave notice of the supposed offense I disagreed so we were waiting on a court date in front of the magistrate and in the meantime they fined me for a 3rd violation $1,000 the maximum before I was even found guilty of the offense. And they did not give me the first or second violation first, just jumped right to the third. Their argument was that each day constituted a new a separate offense but again I was not found guilty yet.
