Q: what are the consequences for 1099 truck driver’s in NJ organizing a strike unless antitrust law does not apply?
Unless I’m wrong, I’ve tried to explain to independent contractor truck drivers who have their own LLCs that they cannot perform an organized strike, even if they coordinated through a 501(c) three association or if they do it just by posting and replying in Facebook that it’s not impossible to expect subpoenas because it’s violating antitrust law potentially, and that they would have to unionize to be able to form an organized, strike effort to fight for higher pay or higher rates or anything. I would love some feedback on why this is wrong or a scenario where fighting for a higher rates as a group of independent contractor truck drivers in New Jersey can organize a strike. They like to use the word strike. They literally want to block the port with their trucks or the highway or drive around slowly and do all kinds of organized activities to fight for higher rates. I’m not saying not to fight for higher rates, I’m saying unless I’m wrong it would have to be through a union
