Q: hopping fences backyard,?by accident broke a fence post burglary too? did not enter building no intent to commit to crim

Significant other and I had altercation. Please recall significant other head, fenced backyard for no longer than five minutes to avoid police and while escaping backyard is being charged with burglary2 he did not enter a building or shelter or intend to commit a crime is considered burglary 2 please help all advice or tips or information would be greatly appreciated. He does have a criminal record and has felony charges, but did not intend to damage property or commit crime wrongfully charged charge. Help me help me help me please.
