Buena Park, CA asked in Criminal Law for California

Q: Can I possess a firearm whilst living in a household with a felon?

The firearm would be locked in a gunsafe and I, alone, would know the combination to it.

A: Under California law, you can legally own and possess firearms while living with someone who has a felony conviction, but you must take specific precautions to prevent the felon from accessing the weapons.

Your plan to keep the firearm in a gun safe with sole access to the combination is a good start, but additional measures are required. The law mandates that you must store firearms in a way that makes them completely inaccessible to the felon - this means using a DOJ-approved safe or security device, and ensuring the felon never has access to keys, combinations, or any means of opening the safe.

Be aware that if the felon gains access to your firearm, both you and they could face serious legal consequences. You could be charged with negligent storage of a firearm or even as an accessory if the felon is found in possession of the weapon. For complete peace of mind, consider consulting with a criminal defense attorney who can review your specific situation and storage plans to ensure full compliance with state and federal laws.
