Q: Why would a case be dismissed on the day a trial was to start; only to have a new case filed the following month.
Arizona Municipal court case was dismissed the day of trial, and following month was refiled with new case number for the same exact charges of ars13-1203a1 and 13-2904A1 in which there was no injury the victim recorded the event with a cell phone camera then went to police dept filed charges. I have learned that in Az you can be charged for assault just by making a person be in fear of an assault. But what statute makes it legal for charges to be dismissed just to be refiled and start a new case number and a new arraignment hearing.
