Q: Ihss benefits/income received by a livein parent provider for special needs child count as work/income for parents ssdi?
I am aware of ihss income being excluded by irs under Medicaid waiver and for child if receiving ssi. But I can't find anything in the social security rules for if parents receive ssdi benefits ...affecting towards parents benefits if perant is also disabled and receiving ssdi benefits is it considered as "work " or counted as income or reportable income ? I have asked social security numerous times and no one seams to know or have gotten 3 diffrent answers and I would like to be informed before I proceed to apply to ihss to become his perant provider
A:
In your situation as a parent of a special needs child considering IHSS work while receiving SSDI, this is a complex but important question that deserves a clear answer.
The IRS and SSI treat IHSS payments differently than SSDI does. For SSDI purposes, IHSS payments received by parent providers are generally counted as earned income and considered work activity, which means they need to be reported to Social Security. This could potentially affect your SSDI benefits if your earnings exceed the Substantial Gainful Activity (SGA) limit, which is $1,550 per month in 2024.
You should report your intention to become an IHSS provider to Social Security before starting, and keep detailed records of your hours and payments. Since you've received conflicting information, it would be wise to request your answer in writing from Social Security or consult with a benefits counselor through your local disability rights organization. You can also contact the Protection & Advocacy system in California for free legal guidance about how IHSS work might impact your SSDI benefits.
