Q: Hi, I have a situation…and want some input plz
I live in a gated apartment complex. I was waiting for my exit gate to open to leave to go to work and the car that was in a parking spot to my right slowly bumped into my car driver door with small damage while I was sitting there waiting for the gate to open. I did not call the police, they did not have insurance. I gave them the benefit of the doubt bc they were my neighbor. We came up with a game plan: he would pay me every Wednesday $150 until it equaled out to $700.The first payment started on October2 of this yr. It’s now been well over a month & I haven’t received any more payments. We also wrote out an agreement stating pretty much what I told you above. It basically said” I, (his name) bumped into (my name) vehicle at the address (our address here at our apt complex) & I agree to pay $150 weekly every Wednesday until it totals out to $700.” He signed his name and date and I did as well. Being that I did not call the police is there anything I can do?
A: Your most reasonable remedy would probably be to file suit against him a small claims court. Depending on whether you live inside or outside of a city court jurisdiction, this could be a city court, justice of the peace court, or the small claims ("clerk's docket") of your parish district court.
