Q: Regarding buying a property with a history
I plan to buy a plot for cheap. There is a seller who has every document to his name, EC, khata etc etc.
Upon inspection, I found that this property has been vacant for 30 odd years, and has been registered a month ago.
This property was sold by his father to another person in 1970s via an unregistered absolute sale deed, with no value written in it, but both his father and the erstwhile buyer have passed away in the 2000s, and since then there have been no claimants to this property, meaning that the seller hasn't registered this specific property to his name.
He is the only son, so there is no inheritance issues.
But the erstwhile seller's kids have houses right next to this property, although they have not made any claims yet.
My question is, can these heirs challenge me in the future with regard to ownership? If they do so, will this stand in court? How risky will this property be?
A: Every State is different as to the title questions you ask. Hire a lawyer to search the title and advise on future litigation. It sounds like a tax sale is imminent.
