Q: How do I get arrears child support from mom credited to what I pay monthly now that the kids moved in with her?
Both Kids 12 and 14 have lived with me since birth, I have full custody of them this past September they moved in with her. She was down just under 30k in child support at that time. Im trying to get my monthly payment reduced by offsetting it with what she owes me.
I filed a motion to change support and attached the arrears report that I have from 21 and the payment history report that I have thru September of this year. The judge denied the motion. Not sure what Im doing wrong
A: It unfortunately does not work that way, which I know is frustrating and makes no sense. But you have to pay the court-ordered amount for child support every month regardless of what she owes you. Like I said, it makes no sense, but it's the situation you're in. If she's not making a monthly payment to you towards what she owes, I'd file a Petition for Contempt and ask the Court to order her to be making monthly payments.
