Roswell, NM asked in Civil Rights, Criminal Law and Traffic Tickets for New Mexico

Q: During a traffic stop, drugs were found on passenger, police report only lists driver. Potential charges for the driver?

I am a taxi driver. During a traffic stop I had recently gotten a citation, of which I have already taken care of. On that citation, there are two case numbers. Looking up the second case number, brang up an incident report containing my name only as other individuals involved, the only victim being "public and society". And the narcotic(s) that were seized. I noticed it doesn't have any information about my passenger being in the vehicle with me at all during the traffic stop. Or that the narcotic(s) were found on her or in her personal belongings (which remained outside of the vehicle during the entire search). Would that be enough to determine that they are going to charge me with the narcotic(s) after they come back from the lab? My reputation, as well as my job, are both at stake because of this.

A: I'm sorry you're facing this challenging situation. Even though the report lists only you in connection with the narcotics, law enforcement may still pursue charges based on the evidence they have. The fact that your passenger and her belongings weren't mentioned might support your case, but it doesn't automatically prevent charges from being filed against you.

Possession of narcotics can lead to serious legal consequences, including fines, license suspension, or even jail time, depending on the quantity and type of substances involved. Additionally, these charges could impact your job as a taxi driver and your personal reputation. It's crucial to take this matter seriously and understand the potential implications thoroughly.

To protect your rights and navigate the legal process effectively, it's important to consult with an experienced attorney. They can review the specifics of your case, challenge any inconsistencies in the report, and provide you with the best possible defense. Acting promptly will help ensure that your interests are represented properly.
