Q: How can i sue the co-borrower and get my half of my marital property ?

My husband (borrower) and his younger brother (co- borrower) own a property since october 2016. My husband marry me in december 2019. In september 2023 the co-borrower quit his job because of a personal argument with the borrower. Mortgage is paid through the co-borrower's bank account. The co-borrower didn't pay the mortgage for about 6 month until the house is sold. I also pay the mortgage for 8 months. The house couldn't be sold without my signature, so the house become a marital property. The co-borrower orally said he will not fight for the money and give it all to the borrower. But at last minute, the co-borrower took the check. I disagree. I am about to divorce my husband, i would like to know how can i claim my economic part of the house which is a marital property?
