Q: I need guidance on a relocation situation in a custody litigation.

I have 50/50 shared custody, but with the final say in decisions. Current stipulation says that if I move away, I have the children with full custody. However, I tried to move in August, other party fought it, and commissioner ordered the children can't change schools.

My landlord is not renewing my lease and has given me until Dec. 31st to move. I cannot provide the court or other party 60 days notice. I cannot find anything nearby to maintain the 50/50 week on week off schedule we have at the moment.

I have created a schedule where if I have the children every other weekend, most all long school vacations, and the summer, the parenting time is still 50/50.

I have a hearing on the 20th where other party is trying to get my petition for full custody thrown out due to disclosure technicalities. Is it best if I withdraw that petition or keep it ?

Is it best for me to file a temporary order citing emergency moving with the new schedule? Or is there another better option?
