Houston, TX asked in Contracts and Small Claims for Texas

Q: Texas JP Court. How to word a request for continuance.

I contracted with a tree surgeon to remove three dead palm trees from my property. I requested that they be inspected prior to removal to ensure that they were in fact dead, and not simply damaged. The tree surgeons employees removed the trees and upon review of the video tapes on my surveillance system, it appeared that they were in fact alive from the green growth they were removing. I refused to pay the $1700 bill. My attorney contacted an expert tree surgeon, who said that they were in fact alive. My attorney filed a countersuit for $45,000 in damages, the replacement value of the trees. I have been advised of a pre trial hearing next week. My attorney passed away unexpectedly before I was fully briefed on his plan including the name of his expert. I contacted the attorney that came into possession of my attorneys computer records and he is looking for the records of my case but has not found them yet. How do I word a request for continuance to allow time to get the records?
